TERMS AND CONDITIONS
It is necessary to read these Terms and Conditions before making your reservation. It is important that you understand the contractual relationship established when using the booking service of Atlantivacations.
Atlantivacations acts as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, lodging, and tourism services. Atlantivacations does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Atlantivacations’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not Atlantivacations. Conditions can change rapidly in a country at any time. The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), and/or purchaser(s), (collectively as “You” and “Traveler”), Atlantivacation (“Atlantivacations“, “We”, “Us”) pursuant to the following terms and conditions (“Terms”, “Agreement)
When making a reservation with Atlantivacations, and when the service of your choice is available, the resulting contract will be between you and Atlantivacations. Should there be any issues before your trip, any and all questions related to the reservation, and any specific questions concerning the chosen services with a Supplier, should be addressed with Atlantivacations.
We do our best to ensure the availability and accuracy of the services published on Atlantivacations, however, some errors may occur within your reservation. Once we become aware of the existence of such flaws, we will do everything possible to inform you of the occurrence within 72 hours after your booking. We reserve the right to cancel your reservation, without any prejudice to you or to Atlantivacations. Should the Supplier cancel or modify your reservation, you will have the option to choose another alternative offered by the Supplier or cancel your reservation. If the Supplier cannot offer a viable alternative within a 72-hour window, we reserve the right to cancel your booking without compensation.
Any commissions, taxes and/or fees required by the government, any other authority, or by the Supplier of the selected service(s) are to be paid for in full by the customer, including any requests made after the issuing of your reservation confirmation.
When a trip organized by Atlantivacations is the subject of a dispute, these general conditions and the specific terms found in the customer’s voucher represent the contract that binds the two parts.
2.1 Cancellation by Customer
Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for that fee or charge.
2.2 Cancellation by Atlantivacations
Atlantivacations reserves the right to cancel an organized trip if the number of participants does not meet the minimum number required when the trip depends on a certain number of participants. In these cases, the customer will be informed via e-mail of the cancellation within 7 days.
If a customer wishes to change their existing reservation date or make any other changes (subject to Supplier availability), the customer must pay an alteration fee. However, should the change take place 30 days or less before the date of the trip, or if the product providers do not accept the changes requested, the customer will be subjected to the fees included in the “Withdrawal” section.
Atlantivacations and its suppliers can alter the order of the routes, modify the departure hours, or replace lodging with others of similar category and localization, whenever there are justifiable reasons.
Customers are free to withdraw from the trip or cancel it altogether at any time. However, they are responsible for paying all the penalties stated in the reservation contract, including all deposits and fees.
Images – Although it is our objective to ensure that all images and descriptions of accommodations are accurate and up to date, this cannot be guaranteed as the information available on the website is provided to Atlantivacations by the Suppliers. The images and information published have the objective of providing a general idea of the accommodations. Please consider that the images of interiors may vary from the accommodations provided to you. Any extra requests may incur additional fees.
Any complaint related to your accommodations should be handled directly with the Supplier and not with Atlantivacations. You should also inform Atlantivacations of any complaint you make to the Supplier.
Additional fees for luggage may apply. If the customer’s luggage is damaged or lost in flight, the customer must file a complaint directly with the airline immediately after noticing the lost or damage. The customer is obligated to file a complaint with the airline the moment their bag is discovered as missing, deteriorated, or destroyed. Atlantivacations is not responsible for any lost or damaged luggage.
2.6 Departure and Arrival Times
The departure and arrival times are indicated in the local time of the respective city. According to the schedules of the airlines on the date of their publication on www.atlantivacations.com, and as such, they may be subject to changes.
2.7 Travel Insurance
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by Atlantivacations to you, constitutes a binding assurance or promise about the insurance. Atlantivacations is not an insurance company and has no responsibility for the submission, payment or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.
3.1 Deposit and Final Payment
For packages, you are required to pay a minimum deposit of 30% of the package’s total amount. The service provider may require further deposits. All deposits are non-refundable. Final payment is required no less than 50 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.
For tours only, the entire amount will be due at the time of booking your reservation. Atlantivacations accepts cash, checks, debit card or credit cards (AMEX, Visa, MasterCard, Discover or Diners). Should you wish us to charge your credit card there maybe a surcharge up to 2.5%.
3.2 Credit Card Transactions
If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider and not against Atlantivacations. If payment has been made to Atlantivacations by credit card, you agree that you will not seek a refund of your payment from Atlantivacations. If the credit card is passed through to the travel services provider, and you seek a refund of your payment from the provider, you agree to be held liable and indemnify Atlantivacations against the refund from the provider. This will include, and without limitation, any air debit memos charged to Atlantivacations. If Atlantivacations incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owed to Atlantivacations.
Atlantivacations does not owe any refund for services that aren’t used by the customer for reasons unrelated to Atlantivacations, or in such case that they cannot be substituted by other equivalents.
The customer is responsible for contacting the relevant Embassy or Consulate for additional information. Requirements may change and you should check for up-to-date information before booking and departure. Atlantivacations accepts no responsibility if you are refused entry onto a flight or into any country due to your failure to carry the correct and adequate passport, visa, or other travel documents required by any airline, authority, or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.
The client must have all the personal or family documentation required (identity card, military documents, minor authorization, visas, vaccination certificates and other necessary documents). Atlantivacations is not responsible for the denial of visas or entrance of the customer into a foreign country. If in such case the customer is denied entry into a foreign country, the customer is still responsible for all costs.
– Customers (whatever their age) who wish to travel outside their home country must have a passport and a visa when necessary. Please note that many countries require that the passport has a minimum validity of six months starting from the entry date into this country. The client is responsible for getting all the information on visa requirements;
– Minors, whenever they are not accompanied by the person who holds parental rights, can only enter or leave national territory by showing a written authorization that is dated and signed by the person holding the parental rights and this authorization must be notarized.
5.1 Atlantivacations Responsibilities
Atlantivacations is not responsible for any damages that may occur during your trip, nor in the case of injury or death. Atlantivacations is responsible only for the errors of its own reservation service and will not be held responsible for the errors of its Suppliers. In any such case, the customer must file their complaints directly with the Supplier(s).
5.2 Customer Responsibilities
The customer is responsible for having all the required documents on his/her person while traveling, and for checking their validity. The customer is also responsible for providing accurate information for all relevant parties while making the reservation. The customer must respect the conditions imposed by the Suppliers. The client cannot behave in an inappropriate manner, as to offend or harm others or destroy the property of others. In these cases, Atlantivacations and its suppliers have the right to cancel your reservation without reimbursement.
5.3 Customer Obligations
The customer agrees to certain obligations, including but not limited to:
• financial responsibility for all the transactions made in their name;
• to be at least 18 years old and have legal capacity;
• all the information concerning the customer and the people accompanying his on the trip must be legitimate;
• Atlantivacations cannot be used for speculative, false or fraudulent reservations;
• the transmission of any threatening, pornographic, political, racist or any other type of illegal material is strictly prohibited;
• the client cannot modify, copy, distribute, transmit, reproduce, publish, license, transfer, sell or derive any information, software, products or services obtained through Atlantivacations. Additionally, the client also accepts:

Atlantivacations offers all the general information on our website for guidance purposes only. Atlantivacations reserves the right to alter any aspect of our website, its content, and the reservation service itself at any time. Including but not limited to, the availability of the Suppliers, certain characteristics, information and/or databases. Atlantivacations does not guarantee that the information is always up-to-date, and it is the responsibility of the customer to make sure that they understand and respect all relevant requirements. Atlantivacations does not guarantee that the information available on the website (including, but not limited to prices, descriptions and dates) is free of errors or omissions. However, we do everything possible to correct any error or omission that might appear in a timely manner.
5.5 Customer Reviews, Comments, Pictures, and Other Submissions
Customers will have the opportunity to send us their opinions on our booking service and/or our Suppliers through a specific form, which will be available after the conclusion of the reservation. After their trip, customers receive an e-mail with a link to a questionnaire, through which they can communicate their degree of satisfaction with our services, as well as provide suggestions for improvements and/or alterations. By completing and submitting this form, the customer agrees to renounce any ownership of the information provided to us. Atlantivacations and its Suppliers reserve the right to use, copy, distribute and/or publish this content through any means. By completing and submitting this questionnaire, the client agrees:
5.6 Force Majeure
Atlantivacations will not be held accountable for any flaws that might occur during the contract when they are caused by force majeure events. These include, but are not limited to government intervention, wars, civil commotion, hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist attacks, or industrial action that might affect Atlantivacations and its suppliers.
The prices displayed on www.atlantivacations.com are expressed in Dollars, however, the currency used in many destinations featured on our website are Euros. When making your reservation, please consider the possible currency fluctuations which may alter the final price of your trip.
5.8 Copyright and Trademarks
Atlantivacations and its subsidiaries, trademarks, logos, photos, videos, texts all other copyrighted material mentioned on this website, are property of their respective owners. The unauthorized use of this content will violate the copyright in force, as well as the trademarks and other intellectual property laws. The material published on the Atlantivacations website is property of Atlantivacations unless otherwise specified.
5.10 Changes to Terms and Conditions
Atlantivacations reserves the right to modify or update the Terms and Conditions related to the use of the reservation service at any time. To continue using this website after changes to the Terms and Conditions is to accept the changes brought to it.
5.11 Governing Law
To the maximum extent permitted by law, these Terms and your use of the website are governed by the laws of State of Rhode Island. You hereby consent to the non-exclusive jurisdiction and venue courts in the State of Rhode Island in all disputes arising out of or relating to the use of this website and these Terms.
Other specific conditions will be included in the information that accompanies each individual reservation.
The present terms and conditions may be complemented by any other specific terms if all parties involved agree.
Due to the constant change of fuel prices, alterations may be made to the fuel supplement included in the price of your reservation.
